MyHealth Subscriber Terms of Use

  1. Definition

1.1     Access & Management Rights
Authority to access the Myhealth EHR App that shall include access, view, manage and modify the Personal Health Record of a Subscriber.

1.2     Access Rights
Authority to access the Myhealth EHR App that allows ‘access only’ rights to view the Personal Health Record of a Subscriber.

1.3     Benefits
Any and all services, promotions, arrangements and facilities offered to the Subscriber during the subscribed period.

1.4     Carer
A person or entity that is entrusted with the role of providing healthcare services to the Subscriber whether

1.4.1     Healthcare Provider: Doctor, nurse, pharmacist, medical officer and other qualified healthcare provider as authorized & conformed to local laws;

1.4.2     Family member or acquaintance whether by legal appointment or moral/ethical responsibility;

1.4.3     An entity whether an individual or institution who is granted the authority to provide care to the Subscriber who have fulfilled the Nominee Requirement.

1.5     Claims
Any cost, expense, damage or other liability (whether in contract, tor or otherwise) arising from any time or condition and includes legal costs on a full indemnity basis.

1.6     Credentials
User ID for the purpose of log in to the Subscriber account whether using email, mobile number, social media ID and any allowed media including the password.

1.7     Custodian
A person or entity that is authorized by the Subscriber to register, view, manage and modify the Personal Health Record.

1.8     Electronic Health Record (EHR)
A combined record that may consist of:

1.8.1     Medical record (such as, but not limited to, vaccination, clinical, medical checkup record & treatment record);

1.8.2     Health lifestyle record (such as, but not limited to, diet, exercise & supplement consumption record);

1.8.3     Medication & Allergy record (such as, but not limited to, long term medication, pain management and allergy list).

1.9     Healthcare Provider
An entity or individual so authorized by the local law & governing body to provide medical care & attention to a Subscriber

1.10     Myhealth Connect Sdn Bhd
The legal entity with Registered (Company No. 1350934-M) who is the absolute owner of Myhealth EHR Apps and all its related products & services whether mobile apps, website, brand and services offered under the Myhealth brand flagship.

1.11     Myhealth Electronic Health Record App
Software or mobile application running on IOS, Android or any other available platform under the Myhealth Electronic Health Record App

1.12     Nominee Requirements
The requirements that is to be met by a Carer, Custodian or any other person(s)/entity in order to qualify as Custodian of a Subscriber in Myhealth EHR. It shall include:

1.12.1     Meeting the legal age as allowed by the local governing laws if an individual; and who shall be of sound mind;

1.12.2     Be registered and is a valid legal entity subject to the local governing laws if a body, corporation, company and/or any entity besides an individual;

1.12.3     Either the individual or entity shall be duly authorized by the Subscriber, whether by application of governing laws or by written consent by the Subscriber and be granted either “Access Rights” or “Access & Management Rights”. The authorization shall be produced by the Subscriber for validation if requested.

1.13     Partner Program
Healthcare Providers are required to sign up for Myhealth Partner Program whereby they will be provided a unique log in Credentials. Thru the Patient Portal, the Healthcare Providers can update, upload, download and procure information on their patient subject to the patient being a registered and active Subscriber.

1.14     Partner Portal
The portal used by Healthcare Providers to access into the Myhealth EHR platform for the purpose of carrying out updates, upload, download and procuring information for the purpose of providing healthcare services to the Subscriber provided the patient is a registered and active Subscriber.

1.15     Subscriber
A person who creates an account in the Myhealth App and agrees to the Terms & Conditions of Use of the Myhealth EHR App where the EHR shall be constituted of this person’s personal information, medical record, medical history and other information hereon after contained in the Myhealth EHR.

1.16     User
A person who has access to and uses the Myhealth EHR whether the Subscriber, Custodian, Carer by logging in using valid Credentials whether granted “Access Rights” or “Access & Management Rights”.

  1. What is Myhealth Electronic Health Record (EHR)

2.1     Myhealth EHR is an online digital record of a person’s personal health record. The EHR can be accessed via the mobile app subject to the availability of network access & system operational requirements.

2.2     Your personal EHR account is created once you subscribe after creating your personal log in Credentials

2.3     As a subscriber you can create, edit, manage and delete your personal EHR.

2.4     You may also grant Custodian rights to an individual or entity subject to them meeting Nominee Representative Conditions.

2.5     The EHR may be created by the Subscriber or the appointed Custodian.

2.6     A Subscriber’s EHR created in Myhealth Electronic Health Record App is the property of the Subscriber and records contained in the EHR shall be treated in accordance to the terms & conditions stated in this agreement.

2.7     MyHealth Electronic Health Record (EHR) is a collection of uploaded EHR by the Subscriber or the authorized Carer and it is agreed that MyHealth Connect Sdn Bhd is not responsible for the accuracy nor use or dissemination of the information contained by the Subscriber or Carer.

2.8     It is agreed that MyHealth Electronic Health Record (EHR) facilitates the storage of the Subscriber(s)’s EHR and that Myhealth Connect Sdn Bhd does not verify the content of the said EHR.

2.9     By agreeing to this agreement, Users hereby grant consent to Myhealth Connect Sdn Bhd to use, copy, transmit, store, analyse and backup the data, whether anonymized or not, that enables Myhealth Connect Sdn Bhd to improve, develop and protect our services including personal data and EHR data; subject to the terms of this agreement. It is the discretion of Myhealth Connect Sdn Bhd to create anonymized statistical data from your data and usage of our services whereby it may be used for product improvisation, to develop new services or products, to identify trends and marketing activities based on your preferences

  1. What is stored in Myhealth EHR and who can access it?

3.1     Medical records such as vaccination, clinical, laboratory test and/or other records/assessments that may be uploaded by a Healthcare Provider in our Partner Program or by the Subscriber.

3.2     Personal information such as name, contact, email, ID, demographics and other personal information for purpose of identifying and use for Myhealth product enhancement purposes (See Item 6.1).

3.3     Medical appointments whether made thru Myhealth portal or by manual entry.

3.4     Access is granted to the Subscriber, their Custodian and Healthcare Provider who is a registered user in Myhealth Partner Program.

3.5     Communication or information updates are done either on the Myhealth app, email notification or via the Patient Portal for the authorized Healthcare Provider.

3.6     The transfer of information between Subscribers-to-Healthcare Provider or between Healthcare Provider-to-Healthcare Provider shall be done via a secured messaging platform to ensure data security & integrity.

3.7     It is the absolute discretion of the Healthcare Providers to agree to any request for information to be made available to the Subscriber via the Myhealth app or Patient Portal whether due to ethical or legal reasons.

3.8     Subscribers may be notified via email and/or other modes of communication on changes made to their EHR account whether by the Healthcare Provider, Custodian or Subscriber. It is the Subscriber’s or Custodian’s responsibility to ensure the veracity and accuracy of the information and their discretion to view/modify/accept/delete such changes.

3.9     Information contained in the EHR may be deleted (but is not obligated) by Myhealth Connect Sdn Bhd in the event of termination of Subscription or on the basis that the information is no longer relevant. Such information may be in the form of EHR or personal information of the Subscriber.

3.10     If breach or abnormality is detected, Users can notify Myhealth Connect Sdn Bhd via support@i-healthconnect.com

  1. Who can subscribe & how do we subscribe?

4.1     Any individual who has reached the legal age as prescribed by the governing law, or who have the written consent of their parent or guardian, who is of sound mind and who has agreed to the Terms of Use, may create an account via the Myhealth EHR App.

4.2     The Myhealth EHR App can be downloaded either via Google Playstore, Apple App Store or any other mobile application platform where it is made available.

4.3     The account is created by signing up using Credentials whether email, mobile number, social media ID or any other identifications provided by Myhealth EHR App.

4.4     Subscribers and/or their Custodians may from time-to-time be required to update their personal information for the purpose of ensuring an accurate and timely dissemination of the EHR to their Healthcare Provider or when utilizing Myhealth EHR Benefits.

4.5     It is the sole responsibility of the Subscriber and/or Custodian to keep information up-to-date and verify the content of the EHR.

4.6     Upon creation of the account, the Subscriber and Custodian (if relevant) agree to the rates & subscription plan and shall make arrangement for the payment of said subscription fee via the approved and available payment channels.

4.7     It is the discretion of Myhealth Connect Sdn Bhd to offer Benefits to the Subscriber(s) whether in the form of promotional offers/events, upgrade of services, partner service(s) or any other producsts/services at any time during the subscribed period.

4.8     It is expressly agreed by the Subscriber and/or Custodian the Myhealth EHR App shall not be used for any unlawful or prohibited acts which could damage, disable or impair the Myhealth EHR Apps or interfere with the use of the App.

  1. Assignment & Termination of Custodian

5.1     A Custodian may be assigned by the Subscriber by:-

5.1.1     Complying with the Nominee Requirement as stated in Definition 1.12

5.1.2     By assigning the authority whether:

a)     Access Rights – whereby the Custodian is granted access to view only and no other rights to the Subscribers account

b)     Access & Management Rights – whereby the Custodian is granted access to view, manage and modify the Personal Health Record of a Subscriber

5.1.3     A Custodian may be allowed authority to multiple Subscriber account provided they have met and satisfied the above conditions and those stated in this Terms of Use agreement.

5.2     A Custodian’s rights may be revoked by the Subscriber at any time by termination notice sent to Myhealth EHR Apps via its Support channel. While Myhealth Connect Sdn Bhd shall take all reasonable effort to terminate the authority & access at the earliest time, Myhealth Connect Sdn Bhd shall not be liable for any loss, damages and/or expense suffered in the interim period and neither shall any claims be accepted in relation to this termination exercise.

  1. Myhealth Connect Sdn Bhd will take all reasonable steps to keep the Personal Information, Electronic Health Record and other information contained in the account secure, including by use of hardware, software and available security measures. However due to the nature of the Internet and constant evolving technology, breaches are still possible. Myhealth Connect cannot and does not guarantee that the information stored on Myhealth EHR App will be completely secure.In the event such a breach is detected, Myhealth Connect Sdn Bhd will take steps to remedy as are necessary under the Privacy Act.

6.1     By providing information into the Myhealth EHR App, including personal information & EHR information; the Subcriber and/or Custodian consents Myhealth Connect Sdn Bhd to:

6.1.1     Collect & store the information from the Subscriber, Custodian or Healthcare Provider and to make such information available for authorized parties to access and use;

6.1.2     Use the information to populate details within other software applications the Myhealth Connect Sdn Bhd licenses or makes available under its products and/or services;

6.1.3     Disclose the information as may be required under the Privacy Act or other applicable Laws;

6.1.4     Access the information to the extent necessary to identify and delete it from Myhealth Connect Sdn Bhd’s cloud servers and information technology systems.

 

      1. Myhealth Connect Sdn Bhd shall make the EHR App and web portal available and provide support via support@i-healthconnect.comWhile Myhealth Connect Sdn Bhd shall take all reasonable steps to ensure optimal access to and update EHR App and web portal at all times, it is acknowledged and agreed that downtime, available access & data loss may sometimes be unavoidable whether by system error or by external factors.In the event such incident occurs, Subscriber(s) and Custodian(s) hereby agree that no compensation claims shall be made against Myhealth Connect Sdn Bhd.

     

  1. Termination of Account or Subscription

8.1     A Subscriber may terminate their account or subscription by communicating their intention via the support@i-healthconnect.com

8.2     While Myhealth Connect Sdn Bhd shall take all reasonable effort to terminate the authority & access at the earliest time, Myhealth Connect Sdn Bhd shall not be liable for any loss, damages, expense suffered in the interim period and neither shall any claims be accepted in relation to this termination exercise.

8.3     Myhealth Connect Sdn Bhd reserves the right to terminate the subscription in the event:

8.3.1     Subscriber and/or Custodian breaches the Terms of Use agreement as stated herein

8.3.2     Creation & use of Myhealth EHR App is not in accordance with the rules stated herein

8.4     Upon termination of subscription, the account access shall be denied whether by Subscriber, Custodian or Healthcare Provider.

8.5     The termination of subscription may or may not result in permanent deletion of EHR or other personal information. Myhealth Connect Sdn Bhd reserves the right to retain a copy in de-identified or encrypted format for back-up or other lawful purposes; where permitted by applicable Laws

8.6     The Subscriber may request a copy of the EHR upon termination provided:

8.6.1     The information contained has not been permanently deleted

8.6.2     Fulfilled payment conditions for the extraction and producing the copy of the EHR which may include cost for search, retrieve, verification, personnel costs, postage or other mode of communication and use of intermediary to provide such access

 

    1. Myhealth Connect Sdn Bhd reserves the right to allow third parties to post advertisements or messages on the Myhealth EHR App or its Website. Unless expressly stated otherwise, Myhealth Connect Sdn Bhd does not endorse the products or services featured in the advertisement.The use of third party products, services and links to external websites are at the User’s risk.

 

    1. To the maximum extent permitted by applicable Laws, Myhealth Connect Sdn Bhd reserves the right to change these Terms and Conditions of Use from time to time and shall take reasonable action to notify the Subcribers and/or Custodians of such changes. Myhealth Connect Sdn Bhd encourages Users to review these Terms and Conditions of Use as and when they access a MyHealth®Electronic Health Record.

 

  1. The provision of service by Myhealth Connect Sdn Bhd, which shall include the Myhealth Electronic Health Record and its related website under the Myhealth flagship, is on “as is” basis and Myhealth Connect Sdn Bhd (subject to applicable Laws and whether express or implied warranties that cannot legally be excluded):

11.1     Shall not be held responsible for the performance or non-infringement of third party rights related to the use of the App or web portal;

11.2     Cannot guarantee that the Myhealth EHR App nor its website is free from malicious virus, ransomware or other conditions that may damage or cause interference to the device that is use on;

11.3     Shall not be held responsible for the administration of healthcare based on information obtained from Myhealth Electronic Health Record App or its web portal

 

  1. Users expressly acknowledge and agree that Myhealth Connect Sdn Bhd is not responsible for any claims connected to or consequences from use of the Myhealth Electronic Health Record App or its web portal; and neither is Myhealth Connect Sdn Bhd liable for any punitive, incidental or any damages arising from the non-performance or use of the Myhealth Electronic Health Record App or its web portal.It is agreed that Myhealth Connect Sdn Bhd and its employees, officers, agents, partners & providers are released from all Claims and indemnified against all claims arising from use of or in connection to Myhealth Electronic Health Record and web portal.
  2. To the extent that Myhealth Connect Sdn Bhd cannot exclude its liability for defective services, the limits of its liability shall be to provide a re-supply of such services as subscribed or by refund of the subscribed services on a pro-rata basis from date of defect reported; whereby such refund is calculated based on the annual subscription rate, provided the said subscription has been paid, and the refund shall exclude any and all other Benefits offered to Users on Myhealth EHR App. The account shall effectively be terminated upon such refund recourse being agreed upon.
  3. Users hereby acknowledge that termination of services due to reasons other than system defects shall not qualify for refund policy and no other claims shall be entertained under such circumstances.
  4. In case of dispute and no resolution can be agreed upon, resolution of dispute shall be via arbitration panel or small claims court instead of in courts of general jurisdiction. It is agreed that any dispute must be brought in by the Subscriber’s in the parties’ individual capacity and not as class member in any purported class or representative proceeding.
  5. This Agreement shall be governed by the laws of Malaysia and its validity construction and performance shall be interpreted in accordance with Malaysian law.
  6. Support and Enquiries

17.1     If Users have difficulties using Myhealth Electronic Health Record App or its web portal, please contact support@i-healthconnect.com

17.2     Contact via other channels although available may result in less efficient response and resolution of case.

Healthcare Service Providers

MyHealth Healthcare Service Provider Terms of Use

  1. Definition

1.10    MyHealth Connect Sdn Bhd

1.12     Nominee Requirements

1.13     Partner Program
Healthcare Providers are required to sign up for MyHealth Partner Program whereby they will be provided a unique log in Credentials. Thru the Partner Portal, the Healthcare Providers can update, upload, download and procure information on their patient subject to the patient being a registered and active Subscriber.

1.14     Partner Portal
The portal used by Healthcare Providers to access into the MyHealth EHR platform for the purpose of carrying out updates, upload, download and procuring information for the purpose of providing healthcare services to the Subscriber provided the patient is a registered and active Subscriber.

The Partner Portal shall provide access to Healthcare Provider for the purpose of accessing & maintaining their account profile & other MyHealth subscribed service(s).

1.15     Subscriber
A person who creates an account in the MyHealth App and agrees to the Terms & Conditions of Use of the MyHealth EHR App where the EHR shall be constituted of this person’s personal information, medical record, medical history and other information hereon after contained in the MyHealth EHR.

1.16     User
A person who has access to and uses the MyHealth Partner Portal by logging in using valid Credentials for purpose of accessing the Healthcare Provider profile and features or accessing & maintaining the Subscriber EHR based on granted “Access Rights” or “Access & Management Rights”.

  1. What is MyHealth Electronic Health Record (EHR)

2.1     MyHealth EHR is an online digital record of a person’s personal health record. The EHR can be accessed via the mobile app subject to the availability of network access & system operational requirements by the authorized Carer.

2.2     The personal EHR account is created once a Subscriber creates a personal log in Credential.

2.3     As a User registered under a Healthcare provider, you may edit and manage your patient EHR subject to authorization granted by the Subscriber and/or Custodian.

2.4     The EHR may be created by the Subscriber or the appointed Custodian.

2.5     A Subscriber’s EHR created in Myhealth Electronic Health Record App is the property of the Subscriber and records contained in the EHR shall be treated in accordance to the terms & conditions stated in this agreement.

2.6     MyHealth Electronic Health Record (EHR) is a collection of uploaded EHR by the Subscriber or the authorized Carer and it is agreed that MyHealth Connect Sdn Bhd is not responsible for the accuracy nor use or dissemination of the information contained by the Subscriber or Carer.

2.7     It is agreed that MyHealth Electronic Health Record (EHR) facilitates the storage of the Subscriber(s)’s EHR and that Myhealth Connect Sdn Bhd does not verify the content of the said EHR.

  1. What is MyHealth Partner Portal

3.1     MyHealth Partner Portal is a web-based portal that can be accessed via personal computer, notebook, tablet and any other device(s) that is supported by the portal.

3.2     Access to the Partner Portal is via a registered user ID & Password.

3.3     Users of the Partner Portal can edit and update their profile and respective modules in the Partner Portal.

3.4     Access to the feature modules is subject to the Subscription Package that has been agreed to.

3.5     It is the responsibility of the Users of the Partner Portal to ensure that data or information is accurate and that Myhealth Connect Sdn Bhd shall not verify the content(s).

  1. What is stored in MyHealth EHR and who can access it?

4.1     Medical records such as vaccination, clinical, laboratory test and/or other records/assessments that may be uploaded by a Healthcare Provider in our Partner Program or by the Subscriber.

4.2     Personal information such as name, contact, email, ID, demographics and other personal information for purpose of identifying and use for MyHealth product enhancement purposes (See Item 6.1).

4.4     Access is granted to the Subscriber, their Custodian and Healthcare Provider who is a registered user in MyHealth Partner Program.

4.6     The transfer of information between Subscribers-to-Healthcare Provider or between Healthcare Provider-to-Healthcare Provider shall be done via a secured messaging platform to ensure data security & integrity.

4.7     It is the absolute discretion of the Healthcare Providers to agree to any request for information to be made available to the Subscriber via the MyHealth app or Partner Portal whether due to ethical or legal reasons.

4.8     Subscribers may be notified via email and/or other modes of communication on changes made to their EHR account whether by the Healthcare Provider, Custodian or Subscriber. It is the Subscriber’s or Custodian’s responsibility to ensure the veracity and accuracy of the information and their discretion to view/modify/accept/delete such changes.

4.9     Information contained in the EHR may be deleted (but is not obligated) by MyHealth Connect Sdn Bhd in the event of termination of Subscription or on the basis that the information is no longer relevant. Such information may be in the form of EHR or personal information of the Subscriber.

4.10     If breach or abnormality is detected, Users can notify MyHealth Connect Sdn Bhd via support@i-healthconnect.com

  1. Who can subscribe & how do we subscribe?

5.2     The MyHealth Partner Portal access is provided upon submission of completed registration form and supporting document to the Myhealth Connect Sdn Bhd administrator.

5.3     The account is created by signing up using Credentials whether email, mobile number, social media ID or any other identifications provided by MyHealth Partner Portal.

5.4     Healthcare Provider(s) may from time-to-time be required to update their personal information for the purpose of ensuring an accurate and timely dissemination of the EHR to their Healthcare Provider or when utilizing MyHealth EHR Benefits.

5.5     It is the sole responsibility of the Healthcare Provider(s) to keep information up-to-date and verify the content of the EHR.

5.6     Upon creation of the account, the Healthcare Provider agrees to the rates & subscription plan and shall make arrangement for the payment of said subscription fee via the approved and available payment channels.

5.7     The invoice shall be sent to the Healthcare Provider in a timely manner whether weekly, bi-weekly or monthly basis.

5.8     Payment of the invoiced amount shall be remitted within 14 working days from the billing date otherwise Myhealth Connect Sdn Bhd reserves the right to charge a monthly late payment fee amounting to 1.5% of the outstanding amount.

5.9     MyHealth Connect Sdn Bhd may offer Benefits to the Healthcare Provider(s) whether in the form of promotional offers/events, upgrade of services, partner service(s) or any other producsts/services at any time during the subscribed period.

5.10     It is expressly agreed by the Healthcare Provider that the MyHealth Partner Portal shall not be used for any unlawful or prohibited acts which could damage, disable or impair the MyHealth EHR Apps or interfere with the use of the App.

  1. MyHealth Connect Sdn Bhd will take all reasonable steps to keep the Personal Information, Electronic Health Record and other information contained in the account secure, including by use of hardware, software and available security measures. However due to the nature of the Internet and constant evolving technology, breaches are still possible. MyHealth Connect cannot and does not guarantee that the information stored on MyHealth EHR App and Partner Portal will be completely secure.In the event such a breach is detected, MyHealth Connect Sdn Bhd will take steps to remedy as are necessary under the Privacy Act.

6.1     By providing information into the MyHealth EHR App & Partner Portal, including personal information & EHR information; the Healthcare Provider consents MyHealth Connect Sdn Bhd to:

6.1.1     Collect & store the information from the Subscriber, Custodian or Healthcare Provider and to make such information available for authorized parties to access and use;

6.1.2     Use the information to populate details within other software applications the MyHealth Connect Sdn Bhd licenses or makes available under its products and/or services;

6.1.3     Disclose the information as may be required under the Privacy Act or other applicable Laws;

6.1.4     Access the information to the extent necessary to identify and delete it from MyHealth Connect Sdn Bhd’s cloud servers and information technology systems.

  1. MyHealth Connect Sdn Bhd shall make the EHR App and Partner Portal available and provide support via support@i-healthconnect.comWhile MyHealth Connect Sdn Bhd shall take all reasonable steps to ensure optimal access to and update EHR App and web portal at all times, it is acknowledged and agreed that downtime, available access & data loss may sometimes be unavoidable whether by system error or by external factors.In the event such incident occurs, Subscriber(s) and Custodian(s) hereby agree that no compensation claims shall be made against MyHealth Connect Sdn Bhd
  2. Termination of Account or Subscription

8.1     A Healthcare Provider may terminate their account or subscription by communicating their intention via the support@i-healthconnect.com

8.2     While MyHealth Connect Sdn Bhd shall take all reasonable effort to terminate the authority & access at the earliest time, MyHealth Connect Sdn Bhd shall not be liable for any loss, damages, expense suffered in the interim period and neither shall any claims be accepted in relation to this termination exercise.

8.3     MyHealth Connect Sdn Bhd reserves the right to terminate the subscription in the event:

8.3.1   Healthcare Provider breaches the Terms of Use agreement as stated herein

8.3.2     Creation & use of MyHealth EHR App is not in accordance with the rules stated herein

8.4     Upon termination of subscription, the account access shall be denied whether by Subscriber, Custodian or Healthcare Provider.

8.5     The termination of subscription may or may not result in permanent deletion of EHR or other personal information. MyHealth Connect Sdn Bhd reserves the right to retain a copy in de-identified or encrypted format for back-up or other lawful purposes; where permitted by applicable Laws

8.6     The Subscriber may request a copy of the EHR upon termination provided:

8.6.1     The information contained has not been permanently deleted

8.6.2     Fulfilled payment conditions for the extraction and producing the copy of the EHR which may include cost for search, retrieve, verification, personnel costs, postage or other modes of communication and use of an intermediary to provide such access

  1. MyHealth Connect Sdn Bhd reserves the right to allow third parties to post advertisements or messages on the MyHealth EHR App or its Partner Portal. Unless expressly stated otherwise, MyHealth Connect Sdn Bhd does not endorse the products or services featured in the advertisement.The use of third party products, services and links to external websites are at the User’s risk.
  2. To the maximum extent permitted by applicable Laws, MyHealth Connect Sdn Bhd reserves the right to change these Terms and Conditions of Use from time to time and shall take reasonable action to notify the Healthcare Provider(s) of such changes. MyHealth Connect Sdn Bhd encourages Healthcare Providers to review these Terms and Conditions of Use as and when they access a MyHealth®Electronic Health Record and Partner Portal.
  3. The provision of service by MyHealth Connect Sdn Bhd, which shall include the MyHealth Electronic Health Record and its related Partner Portal under the MyHealth flagship, is on “as is” basis and MyHealth Connect Sdn Bhd (subject to applicable Laws and whether express or implied warranties that cannot legally be excluded):

11.1     Shall not be held responsible for the performance or non-infringement of third party rights related to the use of the App or Partner Portal;

11.2     Cannot guarantee that the MyHealth EHR App nor Partner Portal is free from malicious virus, ransomware or other conditions that may damage or cause interference to the device that is use on;

11.3     Shall not be held responsible for the administration of healthcare based on information obtained from MyHealth Electronic Health Record App or its Partner Portal.

  1. Healthcare Providers(s) expressly acknowledge and agree that MyHealth Connect Sdn Bhd is not responsible for any claims connected to or consequences from use of the MyHealth Electronic Health Record App or its Partner Portal; and neither is MyHealth Connect Sdn Bhd liable for any punitive, incidental or any damages arising from the non-performance or use of the MyHealth Electronic Health Record App or its Partner Portal.It is agreed that MyHealth Connect Sdn Bhd and its employees, officers, agents, partners & providers are released from all Claims and indemnified against all claims arising from use of or in connection to MyHealth Electronic Health Record and Partner Portal.
  2. To the extent that MyHealth Connect Sdn Bhd cannot exclude its liability for defective services, the limits of its liability shall be to provide a re-supply of such services as subscribed or by refund of the subscribed services on a pro-rata basis from date of defect reported; whereby such refund is calculated based on the annual subscription rate, provided the said subscription has been paid, and the refund shall exclude any and all other Benefits offered to Healthcare Provider(s) on MyHealth EHR App and Partner Portal. The account shall effectively be terminated upon such refund recourse being agreed upon.
  3. Healthcare Provider(s) hereby acknowledge that termination of services due to reasons other than system defects shall not qualify for refund policy and no other claims shall be entertained under such circumstances.
  4. In case of dispute and no resolution can be agreed upon, resolution of dispute shall be via arbitration panel or small claims court instead of in courts of general jurisdiction. It is agreed that any dispute must be brought in by the Subscriber’s in the parties’ individual capacity and not as class member in any purported class or representative proceeding.
  5. This Agreement shall be governed by the laws of Malaysia and its validity construction and performance shall be interpreted in accordance with Malaysian law.

17.2     Contact via other channels although available may result in less efficient response and resolution of the case.
